Plaintiff was working for a rideshare company and driving through an intersection with a green light. As he entered the intersection, a big-box retailer's truck ran a red light and t-boned our client. The retail Company denied liability and claimed they were not responsible for the actions of an independent contractor delivery driver. Through the course of discovery, we established the driver admitted he was unsure about the color of the traffic light. We also overcame the independent contractor arguments and settled our client's case for .00.
Plaintiff was employed as a guard at JFK Airport, where he was responsible for securing the tarmac area around certain aircrafts. As one plane was being loaded, he sat down to complete paperwork, a cargo-tug ran over Plaintiff's leg causing life-changing injuries. Gregory Spektor & Associates conducted an immediate, and thorough, investigation in order to obtain the '911' calls, preserve footage of the incident, and obtain witness statements. Although the Defense disputed the severity of the injuries, and attempted to blame the Plaintiff for filling out his paperwork in the...
Plaintiff, a laborer engaged in demolition work on the date of the accident, was injured when heavy metal shelves fell onto his hand, causing a displaced transverse fracture of the second metacarpal. He underwent open reduction internal fixation surgery and developed carpal tunnel syndrome. We obtained a judgment against the property owner.
Plaintiff, a union carpenter, was pushing a car loaded with construction materials across a loading dock. A wheel on the cart jammed, causing the materials to topple over and fall onto him. We established that the Defendants violated a provision of the New York State Industrial Code and moved for summary judgment.
Plaintiff was travelling through an intersection when a vehicle owned and operated by the City of New York, ran a stop sign causing the collision. The City argued that Plaintiff was driving on the wrong side of the road. However, through depositions and document discovery, we proved the City and their employee were liable for the collision.
Plaintiff, a day laborer, was performing electrical work on a construction project when he fell approximately eight feet from a 12-foot A-frame ladder while installing fire alarms in a newly built drop ceiling. He sustained a closed fracture of his right heel and underwent emergency surgery, as well as several follow-up procedures, including a lumbar decompression. The case involved complex liability issues, including whether a ceiling tile fell onto the ladder causing it to shake, or whether Plaintiff lost his balance and grabbed the tile before falling. Despite these...
Plaintiff, a passenger, was on a lunch break with her co-workers. After eating, Plaintiff's co-worker drove her back in a vehicle owned by their employer, Flying Foods. As they left the food court, they were T-boned by another car that was exiting the parking lot. Flying Foods disputed liability and claimed the Plaintiff was prohibited from suing her employer. We prevailed in a Workers' Compensation hearing and were allowed to sue the employer as well as the owner and operator of the other vehicle involved. We then retained experts to establish the Plaintiff's economic loss due...
Plaintiff was stopped at a broken traffic light waiting for traffic to clear. Two other vehicles entered the intersection and hit each other causing one car to strike the stopped Plaintiff. We deposed every driver involved in the incident as well as representatives from the County where the incident occurred. Ultimately, we secured a settlement with contributions from each party including the County for failing to maintain / repair the traffic light.
Our client was driving along a street towards an intersection. The intersection was controlled by a stop sign for traffic entering the street from the avenue. The Defendant disregarded this stop sign and T-Boned our client who had the right of way. After filing suit, we moved for summary judgment arguing all facts were settled on the liability issue. The court granted our motion and the defendants appealed. Defendants took the position that they would not pay and, despite the defense allegedly having damaging video footage, we were able to recover damages for our client.
A passenger in a private vehicle was struck by an unmarked police car making an improper traffic stop without lights or sirens. Governmental immunity was rejected on motion, and the matter settled pre-trial.
